Cloud and Social Media for Solicitors – In the Wake of the Schrems Decision

It isn’t every day that you find yourself involved in a solicitor’s professional training event that has its finger on the pulse quite as much as the one coming up in Ennis on 16th October!

However, little did I realise when I agreed to do it, that the event would be quite as topical as it has now become. The European Court of Justice decision this week in favour of Max Schrems in his case against the Irish Data Protection Commission has cast cloud and social media platforms in a whole new light.

Cloud computing and social media sites have generally relied upon the EU – US Safe Harbor arrangement prior to this; indeed, Safe Harbor was used by the Irish Data Protection Commissioner to justify her decision in Mr Schrems’s complaint in this jurisdiction against what he claimed was Facebook’s failure protect his data.

But now the ECJ has found the Safe Harbor invalid.

So what does this all mean for anyone using the cloud and social media?
